Murray Preliminary Hearing -- Facts in Evidence

Conrad Murray's Preliminary Hearing is scheduled to begin Tuesday, January 4th. News reports indicate 30 witnesses and that it is expected to last 8 days/2 weeks(?). I thought it might be helpful to have a thread to engage in a serious discussion of what transpires -- all the witnesses that appear and the evidence presented by the Prosecution.

This is not intended to be a place to vent about the cast of players (i.e. "Murdering Murray", etc.) or what the charges should have been but rather to discuss what occurs during the proceedings and what impresssions people have from the witnesses and evidence. Please respect this request. Hopefully members can keep us all updated as events occur and we can offer each other support during what will be a difficult experience.


Preliminary Hearing

In California criminal courts, preliminary hearings are formal court hearings where the Judge determines if there is probable cause to hold the defendant to answer for trial, on charges filed in the Felony Complaint. The hearing is only available if felony charges are filed (and not in misdemeanor prosecutions). It is a "mini-trial," where prosecutors present witness testimony establishing a crime was committed, and how the defendant is responsible.

The Charge -- Involuntary Manslaughter

Dr. Murray "did unlawfully, and without malice, kill Michael Joseph Jackson ... in the commission of an unlawful act, not a felony; and in the commission of a lawful act which might have produced death, in an unlawful manner, and without due caution and circumspection."

Manslaughter is a legal term for the killing of a human being, in a manner considered by law as less culpable than murder. (California Penal Code 192(a).) The law generally differentiates between levels of criminal culpability based on the mens rea, or state of mind. This is particularly true within the law of homicide, where murder requires the intent to kill – a state of mind called malice, or malice aforethought; manslaughter, on the other hand, requires a lack of any prior intention to kill. Manslaughter is usually broken down into two distinct categories: voluntary manslaughter and involuntary manslaughter.

J. Michael Flanagan of the firm Flanagan, Unger, Grover & McCool in Glendale, California has experience with celebrity trials, having represented Britney Spears among other notables. He is the only defense lawyer to be involved in a Propofol criminal case, having successfully defended Amy Brunner, RN in 2004 who was charged with IM in the Propofol death of an 80-year old cancer patient.

Conrad Murray, MD was born in St. Andrews, Grenada. He attended Texas Southern University and graduated with a degree in medicine from Meharry Medical College in Nashville, Tennessee. He completed residences at the Mayo Clinic (MN) and Loma Linda University Medical Center (CA) and specialized in cardiology at University of San Diego and Sharp Healthcare (CA). Murray opened his Las Vegas practice in 1999, followed by a Houston practice in 2006. Dr. Murray has 7 children.

Audiência Preliminar

Nos tribunais da Califórnia criminal, as audiências preliminares são audiências formais, onde o juiz determina se existe causa provável para prender o réu para responder a julgamento, sob a acusação arquivada na Reclamação Felony. A audiência está disponível somente se forem apresentadas acusações criminais (e não em processos contravenção). É um "mini-julgamento", onde os promotores apresentam depoimentos de testemunhas, que estabelece um crime foi cometido, e como o réu é responsável.

A carga - homicídio involuntário

Dr. Murray "fez ilegalmente e sem malícia, matar Michael Joseph Jackson ... na prática de ato ilícito, e não um crime, e na prática de um acto lícito, que poderia ter produzido morte, de forma ilícita, e sem a devida cautela e prudência. "
